Welcome to Ride With Nomads. These Terms and Conditions ("Terms") govern your access to and use of our website, the booking of motorcycle tours, and the rental of motorcycles offered by Moto Adventure, Sociedad Anónima, operating as Ride With Nomads ("the Company," "the Agency," "we," "us," or "our"). By accessing our website, making a reservation, or otherwise using our services, you ("the Client," "you," or "your") agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

Moto Adventure, Sociedad Anónima, doing business as Ride With Nomads, is located at 15 Avenida, 7-31 Zona 13, Guatemala City, Guatemala 01013. Contact: +502 5765-4373 / booking@ridewithnomads.com.


Services Offered


The Company offers guided motorcycle tours and independent motorcycle rentals throughout Guatemala. Tour itineraries, rental units, pricing, and availability are subject to change without prior notice, except as otherwise stated in a confirmed booking.


Booking and Reservations


All bookings are made through our website, WhatsApp, email, or authorized booking partners. A booking is only confirmed once the Client has completed the reservation process and, where applicable, made the required payment. The rental period, tour dates, motorcycle model, and total fees are those selected by the Client during the online booking process, as reflected in the Client's booking confirmation, which forms an integral part of these Terms and of the corresponding rental agreement or liability waiver signed at the time of pickup or tour start.


Payment Terms


Full or partial payment, as specified at the time of booking, is required to confirm a reservation. Remaining balances, where applicable, are due on or before the start of the rental period or tour. The Company accepts payment methods as indicated during the booking process. All prices are listed in the currency stated on the website and are subject to change without notice for bookings not yet confirmed.


Driver's License Requirement


The Client is required to upload a valid driver's license to the booking platform at the time of reservation, for both motorcycle rentals and guided tours. The license must be current, valid, and legally authorize the Client to operate a motorcycle. Most current driver's licenses qualify as internationally valid for this purpose; however, it is the Client's sole responsibility to verify, prior to completing the reservation, that their license is valid and sufficient to legally operate a motorcycle in Guatemala.


The Company shall not be responsible for, and will not issue, any refund in the event that the Client has completed and paid for a reservation and it is later determined that the Client's driver's license is not valid or not sufficient to operate a motorcycle. The Company reserves the right to deny delivery of the motorcycle or participation in the tour if the license presented at pick-up or check-in does not match the document uploaded during booking, or does not meet the requirements described above, without any obligation to refund amounts already paid.


Security Deposit


The Client agrees to pay a refundable security deposit of $1,100 USD, in cash or by credit card, at the beginning of the rental period or tour. This deposit covers any damages to the motorcycle, riding gear, or accessories, as well as any additional costs that may arise. If the deposit is returned in full via credit card, a fee of $1.00 USD will be charged due to bank processing policies. The deposit will be refunded after verifying that the motorcycle has not suffered significant damage and that no outstanding fees or fines are pending.


Rental Period (Motorcycle Rentals)


For independent rentals, the Client has the right to use the motorcycle during the rental period selected during the online booking process, as indicated in the booking confirmation. Any extension of the rental period must be requested in advance and is subject to the Company's availability and approval, and may be subject to additional fees.


Eligibility and Fitness to Participate (Guided Tours)


The Client confirms that they meet the minimum age required by Guatemalan law to operate a motorcycle and possess the physical fitness, health, and riding skills necessary to safely participate in the tour. It is the Client's personal responsibility to assess their own health and riding ability. The Client agrees to comply with all local traffic laws and follow the tour guide's instructions at all times.


Use of the Motorcycle


The Client agrees to use the motorcycle responsibly and comply with all local traffic laws and regulations. Use of the motorcycle for racing, competitions, stunts, or illegal activities is strictly prohibited. The Company is free from any liability for fines incurred during the rental period or tour. The Client is responsible for paying any fines imposed during this time, which will be deducted from the security deposit.


Gasoline Consumption (Motorcycle Rentals)


The Client is responsible for maintaining the gasoline level in the motorcycle during the rental period. The motorcycle is delivered with a full tank and must be returned in the same condition. Any gasoline deficiency will result in a fee of GTQ 200.00 or $30.00 USD, deducted from the security deposit.


Riding Gear and Safety Compliance


The Company requires all tour participants to use certified motorcycle riding gear. While the Company offers a limited selection of safety-certified gear for an additional fee, Clients are strongly encouraged to bring their own gear to ensure proper fit and comfort. The Company is not responsible for issues related to sizing, comfort, or personal preference regarding gear provided. If a Client's gear is deemed unsafe or noncompliant, the Client may be excluded from the tour until suitable gear is secured, without refund or compensation.


Assumption of Risk


The Client fully understands that motorcycle riding and adventure travel involve inherent risks, including but not limited to personal injury, illness, property damage, accidents caused by road conditions or mechanical failure, unpredictable weather, interactions with animals, and other unforeseen events. The Client voluntarily assumes full responsibility for these and all other risks associated with the use of the motorcycle and participation in any tour, including risks arising from road conditions, weather, terrain, and the actions of third parties. The Client agrees to wear a helmet and appropriate safety gear at all times while operating the motorcycle.


Substance Use Policy


The Client agrees not to consume alcohol or any substances that impair judgment before or during a rental or tour. If the Client is found to be under the influence of alcohol or drugs, the Company reserves the right to exclude the Client from participation, or to terminate the rental, without any refund or compensation, and to ensure the safety of all involved. Any violation of this clause releases the Company from any and all liability and voids any obligation to refund the security deposit or any amount paid.


Insurance


The Company is not responsible for any injuries, accidents, losses, or damage to the Client's person or property during a rental or tour. Clients are strongly encouraged to obtain personal travel or medical insurance that covers motorcycle-related activities, accidents, and emergency situations.


Emergency Medical Treatment Authorization


In the event that a Client is injured or becomes ill during a tour or rental period and is unable to communicate their wishes, the Client authorizes the Company and its guides to arrange for emergency medical treatment on their behalf, including transport to a medical facility. The Client understands that they are solely responsible for any costs associated with such medical treatment and transport, and releases the Company from any liability arising from decisions made in good faith in connection with such emergency care.


Maintenance and Repairs (Motorcycle Rentals)


The Client is responsible for keeping the motorcycle in good condition during the rental period. Any damage caused by accident, misuse, or negligence will be the responsibility of the Client and will be deducted from the deposit. If the motorcycle receives damage to any part, new parts will be quoted rather than repairs. The Client has the right to request the damaged parts, subject to availability of spare parts. If parts are unavailable, the Client must wait for them to arrive before the Company replaces the damaged parts.


Return of the Motorcycle (Motorcycle Rentals)


The Client shall return the motorcycle in the same condition it was received, except for normal wear and tear, at the exact date and time stipulated in the rental agreement. The security deposit will be refunded after verifying that the motorcycle has not suffered significant damage.


Cancellations and Refunds


Cancellations made at least 45 days before the tour or rental start date are eligible for a partial refund. Cancellations made with less than 45 days' notice are non-refundable. In the event of cancellations due to extreme weather or mechanical issues with the motorcycles, the Company may offer to reschedule the tour or rental. Refunds are not guaranteed in these cases.


Tour and Rental Modifications


The Company reserves the right to modify or cancel a tour or rental in the event of unsafe weather conditions, road closures, mechanical issues, or other unforeseen circumstances. In such cases, the Client may be offered the option to reschedule. Refunds are not guaranteed under these circumstances.


Photography and Media


The Client grants the Company permission to capture and use photographs, video, or other media of the Client during a tour or rental for promotional and marketing purposes, without compensation to the Client for the use of their likeness in such materials.


Privacy Policy


The Company will protect and handle the Client's personal information in accordance with applicable privacy laws in Guatemala. Personal data will not be sold or used for any purpose beyond the operation and communication related to the tour or rental.


Website Use and Intellectual Property


All content on this website, including text, images, logos, graphics, and videos, is the property of Moto Adventure, Sociedad Anónima or its licensors and is protected by applicable intellectual property laws. The Client may not reproduce, distribute, modify, or use any content from this website for commercial purposes without prior written consent from the Company.


Third-Party Links


Our website may contain links to third-party websites or services not owned or controlled by the Company. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.


Indemnification


The Client agrees to indemnify, defend, and hold harmless the Company, its owners, employees, guides, and representatives from and against any and all claims, demands, lawsuits, damages, losses, fines, or expenses (including reasonable attorneys' fees) arising out of or related to the Client's use of the motorcycle or participation in a tour, including claims brought by third parties, regardless of whether such claims arise during or after the rental period or tour.


Limitation of Liability


To the maximum extent permitted by applicable law, the Company's total liability under these Terms, if any, shall not exceed the amount actually paid by the Client for the rental or tour. The Company shall not be liable for any indirect, incidental, or consequential damages, including loss of enjoyment, travel delays, or lost opportunities. The Client agrees to refrain from making false, misleading, or defamatory statements about the Company, its staff, or its services, and acknowledges that doing so may give rise to legal liability on the part of the Client.


Force Majeure


The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather, government actions, civil unrest, road closures, or other events of force majeure.


Disclaimer of Warranties


The website and services are provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the website or services, to the extent permitted by applicable law.


Changes to These Terms


The Company reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the website. Continued use of the website or services after any changes constitutes acceptance of the revised Terms.


Governing Law and Jurisdiction


These Terms shall be governed by and construed in accordance with the laws of the Republic of Guatemala. Any dispute arising from or related to these Terms, or to any tour or rental booked through the Company, shall be submitted to the competent courts of Guatemala City, Guatemala, and the parties expressly waive any other jurisdiction that may apply to them by reason of their present or future domicile.


Entire Agreement; Severability


These Terms, together with the Client's booking confirmation and any signed rental agreement or liability waiver, constitute the entire agreement between the parties and supersede any prior understanding, whether written or oral. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
